ORDER

(Order of the Court was made by DR.G.JAYACHANDRAN, J.) The instant Public Instant Litigation is filed expressing concern regarding the permitted TASM AC shop close to the Higher Secondary School.

2.The learned counsel for the petitioner states that the shop is located within 80 meters from the Higher Secondary School. 3.Whereas, the counter filed by the District Manager, TASMAC indicates that the subject TASMAC shop is functioning since 2023 and it is incorrect to say that it is situated within 80 meters from the School. In fact, the TASMAC shop is located 155 meters away from the School, whereas the Tamilnadu Liquor Retail Vending (in Shops and 2/4

Bars) Rules, 2003 imposed restriction of only 50 meters from the Educational Institutions.

4.Considering the submissions regarding the distance between the Higher Secondary School and the subject TASMAC shop, we are of the opinion that, though apparently the shop is located beyond the prohibited distance, it is appropriate to leave the matter open for the District Collector to consider the representation of the petitioner dated 13.07.2025 in accordance with law and we leave the matter as such. 5.This Writ Petition is disposed of on the above terms. There shall be no order as to costs.
