Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, directing the respondents herein to forthwith stop the laying of the road through the petitioner property comprised in Survey number 213 situated at Thalayamangalam, Orathanadu Taluk, Thanjavur District on the basis of my representation dated 01.03.2016.

ORDER

This writ petition is filed for a writ of mandamus, directing the respondents to forthwith stop laying the road through the petitioner's property comprised in S.No.213 situated at Thalayamangalam, Orathanadu Taluk, Thanjavur District by considering his representation dated 01.03.2016.

2.The grievance of the petitioner is that respondents 2 and 3 are attempting to lay a road in his patta land.

3. Though this writ petition is pending from the year 2016, the respondents have not filed their counter affidavit to the averments made in the writ petition. On 02.03.2023, the petitioner has sent a letter to the Additional Government Pleader stating that he wants to withdraw this writ petition.

4. The learned Additional Government Pleader appearing for the respondent police submitted that Public Works Department has sent a letter dated 28.02.2023, wherein, it is stated that, since road has been laid for the public purpose, compromise has been reached between the petitioner and the Panchayat and the same was produced before this Court.

5. Recording the submission made by the learned Additional Government Pleader, this writ petition is closed as no further orders are required to be passed. No costs. Consequently, connected miscellaneous petition is closed.

6. The learned Additional Government Pleader appearing for the respondents is directed to furnish the copy of the letter written by petitioner and the also the proceedings of the Public Works Department to the learned counsel for the petitioner.
