ORDER

The petitioner is facing trial before the Mahila Court, Ramanathapuram, in SC.No.41 of 2025, in connection with Crime No.268 of 2024 on the file of the Paramakudi Taluk Police Station, registered for the offence u/s.329(4), 75(2), 351(3) BNS [448, 354(A), 506(2) IPC]. A non-bailable warrant of arrest was issued as against the petitioner on 30.04.2025 and he was arrested on 10.06.2025. Hence, he moved this petition seeking bail.

2.Learned Counsel for the petitioner submitted that the petitioner is working as a Driver and the complaint itself is a foisted one. The petitioner was initially arrested on 18.12.2024 and was released on bail, after a period of sixty days. Thereafter, he was not informed about the date of hearing before the trial Court and he failed to appear before the trial Court on 30.04.2025. Therefore, he was arrested again pursuant to a non-bailable warrant of arrest. After the second arrest, the petitioner is in jail for the past 77 days. Therefore, he sought for bail. 3.Learned Government Advocate (Crl. Side) submitted that the petitioner was initially released on bail and thereafter, he evaded the trial by not appearing before the trial Court on 30.04.2025.

Therefore, a non-bailable warrant of arrest was issued against him and in the meantime, he was secured in connection with another criminal case. Apart from the present case, the petitioner is having two other cases to his credit in Crime No.167 of 2024 and 70 of 2025 and both of them are in the stage of trial in SC.No.160 of 2025 before the Mahila Court, Ramanathapuram and CC.No.194 of 2025 before the Judicial Magistrate Court, Paramakudi. Learned Government Advocate therefore apprehends that the petitioner may not be available for the trial, if he is released on bail.

4.Learned Counsel for the petitioner submitted that the petitioner would stay in a far away place and report before any Police Station. He would also furnish 2/5

adequate sureties to ensure his availability before the trial Court. He would also file an affidavit of undertaking and would appear before the trial Court without any fail and would cooperate for the trial.

5.Considering the manner in which the petitioner has evaded the trial and also considering the petitioner's antecedents, this Court was not inclined to grant bail to the petitioner at the first instance. However, considering the undertaking given by the petitioner, this Court is granting bail to the petitioner, however, with stringent conditions.

6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail on the following conditions:- i) The petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties each for a like sum to the satisfaction of the learned Judge, Mahila Court, Ramanathapuram. The sureties shall be respectable persons from the locality.

ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the Government in proof of their residence address;

iii) The petitioner shall stay at Trichy and report before the Station 3/5

House Officer, Cantonment Police Station, Trichy, daily at 10.30 a.m, until further orders, excepting the dates on which the trial in this case as well as in the other cases was scheduled for hearing. iv) The petitioner shall file an affidavit of undertaking before the respondent police as well as before the Mahila Court, Ramanathapuram, that he will appear before the trial Court and cooperate for the trial in this case as well as in the other cases pending against him.

v) The petitioner shall not misuse the liberty granted to him by indulging in any further offence and shall not tamper with the prosecution witnesses.

vi) On violation of any of the above conditions by the petitioner, the respondent police shall move an application for cancellation of the bail.
