ORDER

The petitioner claims that he is having an issue with his neighboring land owner, who belongs to Schedule caste and therefore, he is foisting a false complaint as against the petitioner by misusing the provision of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities)Act. The respondent Police is also harassing the petitioner based on the false complaint of the third respondent and therefore, the petitioner has filed this petition seeking a direction to the respondent Police not to harass him.

2.The learned Government Advocate(Crl.side) appearing for the official respondents submits that based on the complaint given by the third respondent, an enquiry has been conducted in CSR.No.414 of 2025 and it was closed. However, the third respondent has lodged another complaint and the same is pending.

3.In view of the above submission, this Court directs the respondent Police to conduct preliminary enquiry in a proper and fair manner and take further course of action. The respondent Police shall not harass the petitioner unnecessarily.
