ORDER
This writ petition is filed challenging the order of the second respondent in R.C.No.497/SL 2/2015 dated 24.04.2019 and to direct the first respondent to consider the representation made by the respondent dated 29.04.2015 to relax the qualification.
2.Though there were so much of disputed facts involved in this matter, this Court, at this length of time, is not inclined to go into all those disputed facts.
3.The main grievance of the petitioner is that the request of Cane Commissioner / second respondent dated 13.12.2017 regarding exemption of some qualifications for appointment of Cane Officers, was subsequently withdrawn vide letter dated 24.04.2019 and such withdrawal is in contravention with the understanding reached between the petitioner in I.D.No.86 of 2018. In the memo filed by the petitioner in I.D.No.86 of 2018 before the Labour Court, Kumbakonam, there is a reference about the request made by the Cane Commissioner and based on such request, the petitioner had withdrawn the industrial dispute. Tamil Nadu Cooperative Sugar Mills Managerial Common Cadre System Rules, 2018, the successor to the earlier Cane Commissioner, thought it fit to withdraw the earlier request dated 13.12.2017. 4.This Court is of the view that such course is not in accordance with the understanding reached between the petitioner and the second respondent. Therefore, this Court is of the view that the issue addressed in the present writ petition may be redressed by directing the first respondent to consider the second respondent's request dated 13.12.2017 in respect of relaxation of the educational qualifications for the post of Cane Officers according to its own merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. 5.With the above observations, this writ petition is disposed of.
