This Criminal Original Petition is filed under Section 439(1)(b) of C.P.C., r/w 482 of Cr.P.C., to set aside the first condition imposed on the petitioner in Crl.M.P.No.4100 of 2023 by the Principal District and Session Court, Virudhunagar District at Srivilliputhur dated 14.08.2023.

ORDER

This Criminal Original Petition has been filed to to set aside the first condition imposed on the petitioner in Crl.M.P.No.4100 of 2023 by the Principal District and Session Court, Virudhunagar District at Srivilliputhur dated 14.08.2023. 1/3

2. Learned counsel for the petitioner submitted that the petitioner is a sole breadwinner of his family and he is facing trouble to bear with his entire expenses. Hence, he is not in a position to deposit the amount of Rs.1,00,000/- as directed by the Principal District and Session Court, Virudhunagar District at Srivilliputhur.

3. The condition was imposed by the Principal District and Session Court, Virudhunagar District at Srivilliputhur. If the petitioner wants any modification or to set aside the condition, he must approach the concerned Court. There after only he can move this Court.

4. This Criminal Original Petition is dismissed, directing the petitioner to approach the concerned Court for setting aside any conditions by filing appropriate petitions.
