ORDER

Heard the learned counsel for the writ petitioner and the learned Additional Government Pleader for the respondents 1 and 2. Issuance of notice to the third respondent is dispensed with. 2.The writ petitioner filed a partition suit in O.S.No.170 of 2019 on the file of the Sub Court, Devakottai against five defendants. The third respondent herein is the purchaser from the defendants in the suit. The suit has been dismissed for default on 25.10.2024. The petitioner apprehends that the third respondent may deal with the property and create further encumbrances. Hence, this writ petition has been filed. 3.This relief can be obtained only from the jurisdictional Civil Court. The petitioner has filed I.A.No.3 of 2025 for restoration of the suit. The said restoration application had also been filed with delay. I can only make an observation that any transaction which the third 2/4

respondent may enter into will have to abide by the outcome of the partition suit, if it is restored. The petitioner is at liberty to workout his rights before the jurisdictional Civil Court. 4.This writ petition is disposed of accordingly. No costs.
