PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, to direct the respondents to produce the person or body of the detenue namely Suganthi, D/o. Late. Sivanandi aged 15 years before this Court and hand over the custody to the petitioner.

O R D E R

This Habeas Corpus Petition has been filed by the mother of the detenue that her own daughter, aged about 15 years has been missing on and from 25.06.2025.

2.In this connection, FIR had been registered in Cr.No.22 of 2025, under Section 9 of Prohibition of Child Marriage Act, 2006 by the Inspector of Police, All Women Police Station, Sanarpatti, Dindigul District. Since there is a possibility of provision of law being altered, the investigating officer may take appropriate steps to conduct further investigation.

3.The child being produced before this Court and expressed her willingness to go along with her mother. The mother of the child is also present before this Court. We would not deal with the matter further, since it is the prerogative of the jurisdictional Court to undertake the further proceedings in Cr.No.22 of 2025.

4.In view of the fact that the minor child has now been produced and handed over to her mother, this Habeas Corpus Petition stands closed.
