ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police 1/3

for the alleged offence punishable under Sections 11(1), 11(4), 12 of POCSO Act and 296(b) of BNS, 2023 in Crime No.2 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 17.02.2025, the petitioner followed the defacto complainant and made gesture and at evening 5.45 p.m., when the defacto complainant was waiting for bus, the petitioner told the defacto complainant that he is in love with the defacto complainant and demanded to marry him. Hence the case.

3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate(Crl.side) for the respondent submits that the petitioner is a married man. The defacto complainant is a school going child. The petitioner interfered with the defacto complainant while she was returning to home. He further submits that the petitioner is having ten previous cases. 2/3

5.Considering the facts and circumstances of this case and also the fact that the petitioner is having ten previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
