...Contemnor/3rd Respondent/3rd Respondents PRAYER: Contempt Petition is filed under Section 11 of Contempt of Courts Act, 1971, to initiate contempt proceedings under section 11 of the Contempt of courts Act, 1971 against the Contemnor/3rd respondent herein for his willful disobedience to comply the interim order passed by this court in W.M.P. ORDER

The contempt petitioner has challenged an order of the Revenue Divisional Officer dated 19.06.2023 and the earlier order of the Tahsildar in that regard. An interim order dated 30.04.2025 was issued staying the portion of the order restraining the petitioner from dealing with their respective plot. 2.Learned counsel for the contempt petitioner submits that the revenue officials have violated the said order by preventing the petitioner from putting up a house on the plot. On instructions, learned counsel confirms that it is a house and not a religious structure.

3.Learned Additional Government Pleader relies on written instructions and submits that the prior approval of the District Collector is necessary before putting up a religious structure. Even as regards the house, he submits that approval from the local authority is necessary. 4.By taking note of the submission of learned counsel for the contempt petitioner that only a house is being put up on the plot, this contempt petition is disposed of by recording that the petitioner may proceed with the construction, 2/4

subject to obtaining approval of the local authority concerned. It is needless to say that the Revenue officials shall not interfere with such construction. No costs.
