ORDER : The Court made the following order :- The petitioner/Accused, who is arrested and remanded to judicial custody on 1/3

17.08.2024 for the offence punishable under Sections 8(c) r/w. 20(b)(ii)(c), 29(1) of NDPS Act, in Crime No.227 of 2024, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner was in possession of 1.6 kgs of Ganja. Hence, the complaint.

3.Heard the learned counsel on either side and perused the material records of the case.

4.Considering the nature of allegation in this case that initially a quantity of 1.6 kilograms of ganja is said to have been recovered and initially the petitioner was granted interim anticipatory bail and thereafter, the anticipatory bail petition was dismissed and the petition was arrested on 17.08.2024 and thereafter, on the confession of the other co-accused, further contraband has been recovered and so far now the total quantity stands at 23.600 kilograms and since it is mentioned that further investigation is also on, at this crucial juncture, it may not be appropriate to enlarge the petitioner on bail when the investigation is proceeding and therefore, for the present, I am not inclined to enlarge the petitioner on bail. 2/3
