Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned order Ku.Aa.En.004528/Ni.Pi-IV/0o. 1/Ko.0.Na/2025 dated 16.04.2025 passed by the second respondent quash the same as arbitrary, illegal and unsustainable and consequently direct the respondents to restore the petitioner's salary and to computed all retirement benefits on the basis of the restored salary. 1/5

ORDER
The instant writ petition has been filed challenging the order dated 16.04.2025 passed by the second respondent as illegal and unsustainable and consequently to direct the respondents to restore the petitioner's salary and to compute all retirement benefits on the basis of the restored salary.
2.Mr.S.Arivalagan, learned Standing Counsel, takes notice for the respondents.
3.By consent, this Writ Petition is taken up for final disposal at the admission stage itself.
4.As against the order passed by the Superintending Engineer, there is an efficacious alternative appeal remedy before the Chief Engineer. The petitioner without availing such appeal remedy has filed the present writ petition and the same is not sustainable. 2/5
5.At this juncture, the learned counsel for the petitioner submitted that the petitioner has already filed an appeal before the first respondent on 23.05.2025 and the same is yet to be taken on filed. 6.In view of the above submission, this Writ Petition is disposed of on the following directions:
(1)The petitioner is directed to re-send a copy of the appeal dated 23.05.2025 along with all necessary documents to the first respondent within a period of two weeks from the date of receipt of a copy of this order.
(2)On receipt of the same, the first respondent is directed to consider the said appeal and dispose of the same within a period of twelve weeks therefrom.
No costs. Consequently, connected miscellaneous petition is closed. 28.08.2025 Index : Yes / No NCC : Yes / No ta 3/5
