This writ petition has been filed for a direction to the respondents 3 to 5 to cancel the order of appointment issued to the sixth respondent, as the same is ex-facie illegal and appoint the petitioner as Noon Meal Organizer in Panchayat Union Primary School, Kumbakudi, Sooriyur Post, Thiruverumbur Taluk, Tiruchirappalli District.
2. The case of the petitioner is that he is a resident of Kumbakudi Village and she participated in the selection process for the post of Nool Meal Organizer in Kumbakudi Village, whereas the sixth respondent is a resident of Gundur Village, which is situated 7 kms. away from Kumbakudi. However, the sixth respondent was selected to the post of Noon Meal Organiser. Therefore, the petitioner has requested the respondents 3 to 5 to serve a copy of the appointment order. But the same was not issued to the petitioner till date and hence, she is not able to challenge the appointment order.
3. When the matter is taken up for hearing today, the learned Special Government Pleader appearing for the respondents 1 to 4 has produced the copy of the appointment order and the same has been served to the learned counsel for the petitioner.
4. The learned counsel appearing for the petitioner seeks liberty to file a fresh writ petition, challenging the appointment order issued in favour of the sixth respondent.
5. The learned Special Government Pleader appearing for the respondents 1 to 4 has no serious objection to file a fresh writ petition.
6. Considering the limited request made by the learned counsel for the petitioner, this Court, without expressing any opinion on the merits of the matter, grants liberty to the petitioner to file a fresh writ petition, challenging the order of appointment issued in favour of the sixth respondent.
7. In view of the above, this Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
