ORDER

The instant writ petition has been filed by a Junior Assistant working in the respondent University challenging the show cause notice dated 25.08.2023. 1/4

2.A perusal of the papers indicate that the show cause notice was issued to the writ petitioner on 30.06.2023 without enclosing a copy of the enquiry report. Thereafter, after finding out the defects in the said notice, the University has issued the present impugned notice on 25.08.2023 wherein they have recalled the show cause notice dated 30.06.2023. Along with the impugned notice, a copy of the enquiry report has been enclosed. The petitioner has been directed to submit her explanation within a period of 10 days. This show cause notice is under challenge in the present writ petition. 3.According to the learned counsel for the writ petitioner, when the show cause notice issued on 30.06.2023 was recalled, the second show cause notice which is impugned in the present writ petition is not maintainable. 4.

Per contra, the learned Standing Counsel appearing for the University pointed out that the notice dated 30.06.2023 was withdrawn only on the ground that the enquiry report was not enclosed along with the show cause notice. 5.The above said undisputed facts clearly disclose that the show cause notice dated 30.06.2023 has been recalled only on the ground that the enquiry report has not been enclosed. Now, under the impugned notice dated 25.08.2023, the enquiry report has been enclosed. Therefore, the petitioner cannot have any grievance over the said impugned notice.

6.In view of the above said facts, the petitioner is directed to submit her explanation on or before 12.11.2024.
