ORDER

This Criminal Original Petition had been filed to relax the condition imposed by the learned Principal Sessions Judge, Kanyakumari in Crl.M.P.No.3792/2023, dated 26.07.2023 and set aside the same. 1/4

2.The contention of the petitioner is that as per the order passed by the learned Principal Sessions Judge, Kanyakumari in Crl.M.P.No. 3792/2023, dated 26.07.2023, the petitioner is directed to appear before the Judicial Magistrate, Tenkasi daily twice at 10.30 a.m and 05.00p.m till 22.08.2023. However, due to his illness he could not comply with the condition thereafter. Hence, prays to relax the condition. 3.Considering the facts and circumstances of the case and nature of offence, this Court is inclined to relax the condition No.2 in Crl.M.P.No. 3792/2023, dated 26.07.2023, passed by the learned Principal Sessions Judge, Kanyakumari. In respect of other conditions, in the order of the Principal Sessions Judge, Kanniyakumari District at Nagercoil, shall remain unaltered. 4.Accordingly, this petition stands allowed.
