Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.PRAKASH.R, Advocate for the petitioner and of Mr.M.SAKTHI KUMAR, Government Advocate (Crl. side) on behalf of the Respondent, the Court made the following order:- Perusal of record shows that when the Criminal Appeal was taken up for hearing, the previous Bench has ordered the matter to be taken up finally with the following observation:
"Post the case on 17.08.2023 at 12.00 Noon finally. No further adjournment shall be granted".
2. On 17.08.2023, it was submitted before this Court that the father of the learned counsel on record died. After that the matter was taken up on 04.09.2023. Thereafter, it was not listed. In the meantime, the present Crl.M.P(MD)No.10745 of 2024 is filed seeking suspension of sentence without complying the direction passed by this Court by order dated 11.08.2023.
3. It is further seen that the earlier application was filed by the petitioner in Crl.M.P.(MD)No.6276 of 2022 was dismissed by order dated 12.07.2022. It is the specific order of this Court to argue the main appeal itself, therefore, it is not proper on the part of the petitioner to seek suspension of sentence once again after change of roster. Therefore, the present application is not maintainable. The petitioner must comply the earlier direction of this Court. 2/3
