O R D E R

The Writ Petition is directed against the order dated 24.11.2021 passed by the first respondent.

2. The main contention of the learned counsel appearing for the writ petitioner is that the first respondent, on the representation given by the husband of the fourth respondent and father of the respondents 5 and 2/6

6 Kesavan, has not issued any notice nor conducted any enquiry and passed the impugned order dated 24.11.2021, on the basis of the report given by the third respondent dated 05.02.2021 and that since the impugned order came to be passed in violation of principles of natural justice, the writ petitioner is constrained to file the present writ petition.

The learned counsel appearing for the respondents 4 to 6 would submit that the writ petitioner had taken part in the enquiry conducted by the second respondent and also in the enquiry before the first respondent. But the learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that there is no material to suggest that notice was given to the writ petitioner and the writ petitioner was also heard before passing the impugned order.

4. Considering the above, this Court has no hesitation to hold that the impugned order came to be passed in total violation of principles of natural justice and the same is liable to be set aside.

5. In the result, this Writ Petition is allowed and the impugned order dated 24.11.2021 is set aside. The first respondent is directed to 3/6

give notice to the writ petitioner as well as the other interested parties including the respondents 4 to 6 and conduct enquiry and pass orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
