The above application has been filed under Section 5 of Limitation Act, to condone the delay of 96 days in filing the Cross Objection in C.M.A(MD)No.569 of 2022, which was filed against the order, dated 20.01.2022 in M.C.O.P.No.103 of 2018 on the file of the Motor Accident Claims Tribunal, Additional District Court, Virudhunagar. 2/4

2. When the matter is taken up for hearing today, the learned counsel appearing for the petitioners/Cross objectors would submit that CMA(MD)No.569 of 2022, was already disposed of on 28.06.2023 and hence, seeks permission of this Court to withdraw this application and she has also made an endorsement to that effect.

3. In view of the same, the Civil Miscellaneous Petition is dismissed as withdrawn. Consequently, the Cross Objection is rejected at the SR stage itself. No costs.
