Mr.B.Nambiselvan Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.8 / 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/ Sole Accused who apprehends arrest at the hands of the respondent police for the offences under Sections 354, 506(2) of IPC and Section 4 of TNPHW Act, in Crime No.8 of 2023, on the file of the respondent police, seeks 1/3
anticipatory bail.
2. The case of the prosecution is that on 17.04.2023, the defacto complainant who is a student of M.Sc.,II year, Psychology Department of Madurai Kamaraj University, Madurai, has given a complaint stating that the Head of the Department of her department is sexually harassing her continuously. Hence the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent, he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution.
4. Learned Additional Public Prosecutor would submit that the defacto complainant who is the victim girl / student, was harassed by her Head of the Department, verbally and sexually and a case was registered.
5. It appears that after cancellation of bail, that was granted to the petitioner by the trial Court was subsequently cancelled by the learned Principal District Judge, Madurai. Later he moved Cr.M.P.No.5146 of 2023 that came to be dismissed by order dated 08.09.2023. Now this petition has been filed on the ground that without any additional ground, this petition has been filed.
6. Once bail has been cancelled, then, the course available to the petitioner is to surrender before the concerned Court and seek regular bail. There is no question of second anticipatory bail, without any change of circumstances or grounds. 2/3
