PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 35 of 2023 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioners/Accused Nos.2,4,5,6 and 8, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 498(A), 323, 494 and 109 of IPC in Crime No.35 of 2023, on the file of the respondent police, seek anticipatory bail.

2.The defacto complainant lodged the complaint stating that she and the first accused came to known each other through face book. Later become lovers and decided to marry in the year 2022. Later he went to Qatar. In the month of June 2022 he returned to India. At that time, she demanded marriage. They rented a house and living as husband and wife. Thereafter they performed marriage in a temple on 03.06.2022. Later he was informed that the parents of the first accused arranged marriage with another woman, to be held on 09.06.2022. That was not liked by him. Therefore, he consumed rat poison. Therefore, she went to the hospital to met him. At that time the relatives of the first accused caused assault upon the defacto complainant. Thereafter, she stopped the marriage. Later, he went to Qatar and 2/5

returned back to India in the month of May 2023. At that time, she came to know that the first accused married another woman. When she was enquired about the second marriage, she was abused and assaulted by the accused persons. Over which, the above said complaint has been given. 3.The learned counsel for the petitioners would submit that the petitioners do not know the defacto complainant.

4.The learned Government Advocate (Crl. Side) would submit that the petitioners are the in-laws of the defacto complainant. Investigation is still pending. 5.Considering the limited overt act attributed against the petitioners, this Court is inclined to grant anticipatory bail to the petitioners on conditions.

6. Accordingly, this Criminal Original Petition is allowed and petitioner are ordered to be released on bail in the event of arrest or on their appearance, before the learned Judicial Magistrate No.V, Madurai, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned 3/5

and the petitioners shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7.
