PRAYER IN CRL MP(MD)No.6728 OF 2022:

To Suspend the sentence imposed by judgment made in C.A.No.29/2021 passed by the learned 2nd Additional District and Sessions Judge, Thanjavur dated 30.03.2022 in confirming the order of the conviction and sentence dt 24.02.2021 in STC No.15 of 2018 on the file of the learned Judicial Magistrate, Fast Track Court, Thanjavur.

PRAYER IN CRL RC(MD)No.540 of 2022:

Pleased to call for the records pertaining to the impugned judgment and conviction passed by the learned Judicial Magistrate, Fast Track Court, Thanjavur dated 24.02.2021 made in S.T.C.No.15 of 2018 and which is confirmed by the learned 2nd Additional District and Sessions Judge, Thanjavur in C.A.No.29 of 2021 dated 30.03.2022 and set aside the same and allows the above revision petition. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.K.M.KARUNAKARAN, Advocate for the petitioner and of MR.S.MAHESH BABU, Advocate on behalf of the Respondent, the court made the following order:- Today, this matter is listed under the caption 'for reporting compliance'.

CRL MP(MD) No.13178 of 2022 2.The learned counsel for the revision petitioner submitted that the he has paid Rs.1,50,000/- to the credit of this case, before the concerned Court.

3.Now, the learned counsel for the respondent seeking permission to withdraw the amount deposited by the petitioner. The learned counsel for the petitioner disputed the same and stated that the liability itself is under dispute, however, he is giving consent to withdraw 50% of the deposited amount.

4.In view of the above, the respondent is permitted to withdraw 50% of the deposited amount, which was deposited by the petitioner herein before the trial Court by filing appropriate application. 5.Accordingly, this Criminal Miscellaneous Petition is disposed of.
