2.When the matter is taken up for hearing today, the learned Additional Public Prosecutor submitted that out of the four accused persons first accused is reported to be dead and charges framed against him abated and other accused persons are facing the charges. So far 61 witnesses have been examined out of 78 witnesses. 14 witnesses have been dispensed with. Cross examination of all the witnesses have also been completed. Now the case has been posted for examination of the Investigating Officer. Only to drag on the proceedings this petition has been filed by the petitioner.

3.Since the Investigating Officer is going to be examined and the case is also going to be disposed of after completing the above said examination, nothing survives for further consideration or adjudication in this case. This petition deserves to be dismissed. 4.Accordingly, this criminal original petition is dismissed. Consequently, connected miscellaneous petition is closed. 2/4
