Respondents PRAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus to direct the second respondent to produce the body or person of the petitioner's son namely, R.Tamilarasan son of S.Rajangam aged about 27 years, before this Court and set him liberty.

ORDER

[Order of the Court was made by N.ANAND VENKATESH, J.] This Habeas Corpus Petition has been filed by the father of the detenu to produce the body of his son Tamilarasan, went missing from 19.08.2022 onwards.

2. The learned Additional Public Prosecutor, on instructions, submitted that the detenu has several criminal cases against him and presently two cases are at the stage of investigation and in two other cases, he was facing trial. On enquiry, it is ascertained that the detenu had developed intimacy with the wife of one Periyasamy and when this came to the attention of the said Periyasamy, there was some threat. Thereafter, the detenu went missing. The learned Additional Public Prosecutor further submitted that all efforts are being taken to find the whereabouts of the detenu.

3. Taking into consideration of the facts and circumstances of the case, it will suffice if a direction is given to the second respondent police to follow the guidelines issued by this Court in K. Sukumari Vs. The Superintendent of Police, Virudhunagar District, Virudhunagar, reported in 2018(2) - L.W. (Crl) - 636. This Court expects the respondent police to expedite the investigation and find the whereabouts of the detenu as early as possible.
