Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for R1.
2.This criminal original petition has been filed to quash the FIR in Crime No.49 of 2019 registered on the file of the first respondent. I am not satisfied that a case for quashing has been made out. Therefore, the first respondent is directed to file the final report within a period of four weeks from the date of receipt of copy of this order. The jurisdictional magistrate shall take a call within two weeks thereafter. If the jurisdictional magistrate rejects the final report, then, it is in favour of the petitioner. https://hcservices.ecourts.gov.in/hcservices/ 1/2
If the jurisdictional magistrate takes cognizance of the offences, the trial itself will be concluded within a period of four months thereafter. I have not gone into the merits of the matter. All the contentions of the petitioners are left open. The criminal original petition is disposed of.
