PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to transfer the enquiry of the Petitioner's complaint, dated 19.10.2022 on the file of the third Respondent to the second Respondent for conducting an enquiry under the Code of Criminal Procedure.

The learned Counsel for the Petitioner submitted that this Criminal Original Petition had been filed seeking to transfer the enquiry of the Petitioner's complaint, dated 19.10.2022 on the file of the third Respondent to the second Respondent for conducting an enquiry under the Code of Criminal Procedure. 2.The learned Additional Public Prosecutor submitted that based on the complaint of the Petitioner, C.S.R.No.478 of 2022 was issued and both parties were enquired. On enquiry by the Respondents 3 and 4, it is found that the property in S.No.91/3 is a Sarkar Poramboke, as per the revenue records. Therefore, both the parties were advised to seek their remedy through Civil Court and the petition was closed.

3.Recording the submission of the learned Additional Public Prosecutor, this Criminal Original Petition is disposed of with a direction to the Petitioner to seek her remedy through Civil Court. 17.11.2022 Index:Yes/No cmr 2/4
