ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of I.P.C r/w 21(1) of MMDR Act, 1957, in Crime No.136 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 26.08.2023, when the defacto 1/3

complainant lodged a complaint stating that without permission the accused persons broken the rock in a private property. They seized two compressor vehicle. Hence, the complaint against the land owner as well as the vehicle's owner. 3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. The petitioner is the owner of the JCB. The vehicle was hired for agricultural purpose. 4.The learned Government Advocate (Crl. Side) would submit that the petitioner is having four previous cases. Hence, he opposes the grant of anticipatory bail to the petitioner.

5.Considering the bad antecedents of the petitioner this Court is not inclined to grant anticipatory bail to the petitioner.
