PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :- For Bail in Crime No.110 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Accused No.3, who was arrested on 27.06.2023 for the alleged offence under Sections Man Missing @ 364A, 395, 397 IPC and Section 25(1-B)(a) 1/4

r/w Section 3 of Arms Act, in Crime No.110 of 2023, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 24.06.2023 the defacto complainant along with her husband came to her parental home at about 10.30 a.m. Thereafter, her husband went to his relative's house. At about 01.00 p.m., she tried to contact him through phone, but it was not attended by him. Again, at 7.00 p.m., when she tried to contact him, there was no connection. She waited till 26.06.2023. Thereafter, she lodged a complaint stating that her husband went missing and must be traced out. During the course of investigation, it was found that the petitioner and other five persons kidnapped the husband of the defacto complainant under gun point in front of Indira Ganesan College bus stop and demanded money, which he borrowed from the first accused. Hence, the case.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and there is no recovery from this petitioner. The petitioner is in custody from 27.06.2023. Hence, prays to release him on bail. 4.The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is not having any previous case at his credit.

5. Only on the ground that the petitioner is entitled to be released on statutory bail within two days, without going into other facts and merits of this case, this 2/4

Court is inclined to grant bail to the petitioner with certain conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.1V, Tiruchirappalli, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
