ORDER

The Criminal Original Petition has been filed to withdraw the case in Crime No.283 of 2009 on the file of the third respondent and to transfer the same to the fourth respondent or any other agency.

2. The learned counsel for the petitioner would submit that though earlier two orders have been passed by this Court in Crl.O.P. (MD)Nos.7570 of 2011, dated 19.07.2011 and Crl.O.P.(MD)No.15448 of 2011, dated 23.04.2012, there is no progress in the investigation and that even after the case being transferred to the CBCID, the respondents are very lethargic in conducting investigation. 1/3

3. Per contra, the learned Government Advocate (crl.side) would submit that the case was transferred to the CBCID on 10.06.2013 and that the respondents have been sincerely doing the investigation in an effective manner and they have sofar examined 447 witnesses.

4. The respondents have also filed the status report. As per the status report, the respondents have examined 447 witnesses. This Court having gone through the status report does not find any reason to transfer the investigation as of now.

5. In view of the same, a direction is issued to the third respondent / Inspector of Police, CBCID, Tirunelveli, to expedite the investigation and to complete the investigation and file a final report, preferably within a period of four months from the date of receipt of a copy of this order.

6. With the above direction, this Criminal Original Petition stands disposed of.
