Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to promote the petitioner to scale II officer in the Pandian Grama Bank by including the petitioner's name in the eligible candidates list to promote officers from scale I to scale II published vide PAD Circular No.PAD/63/2015-16 dated 09.03.2016 with immediate effect.

Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the second respondent's circular in PAD/54/2010-11 dated 29.12.2010 and quash the same as it is ultra vires and contrary to the RRB 2/6

Rules and consequently direct the respondents to promote the petitioner to Scale- II officer in the Pandian Grama Bank by including the petitioner's name in the eligible candidates list to promote officers from scale- I to scale -II in the Circular No. PAD/63/2015-16 dated 09.03.2016 with immediate effect. The Writ Petition in W.P.(MD).No.6913 of 2016 is filed to challenge the circular dated 29.12.2010 with a consequential relief to grant promotion.

2. Pending Writ Petition, the respondents have granted promotion in the year 2016 itself. Hence, the issue has becomes infructuous. 3/6

3. Subsequently, the said Bank is merged with the Tamil Nadu Grama Bank. The learned counsel appearing for the petitioner submitted that on merger, he could not ascertain whether the circular is still in force or not. Therefore, this Court is not inclined to entertain this Writ Petition. But the issue raised in this Writ Petition is left open.

5. Hence, the Writ Petitions are dismissed as infructuous. No costs. Consequently, connected miscellaneous petitions are closed. 22.06.2023 NCC : Yes/No Index : Yes / No Internet : Yes/ No Nsr 4/6
