ORDER

This Criminal Original Petition has been filed, invoking Section 528 of BNSS, seeking orders, to quash the FIR in Crime No.16 of 2024, dated 14.01.2024 on the file of the first respondent police.

2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the State would submit that the first respondent, after completing the investigation, has already filed the final report on 03.10.2024 through e-filing before the learned Judicial Magistrate, Eraniel. He would further submit that the counter FIR, in Crime No.15 of 2024, charge sheet has been filed and the case was taken on file in C.C.No.35 of 2024 on the file of the learned Judicial Magistrate, Eraniel.

3. In view of the above, the learned Judicial Magistrate, Eraniel, is directed to take the charge sheet filed by the first respondent in connection with Crime No.16 of 2024 on file if it is otherwise in order within a period of one week from the date of receipt of copy of this order and in case, there is any defects, the first respondent is directed to rectify the defects 2/4

and resubmit that same within one week and on receipt of the same, the learned Magistrate is directed to take the case on file within one week thereafter.
