For Respondent : Mr.M.Vaikkam Karunanithi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.621/2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioners/A1, A2 & A4, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 323, 355, 506(i) and 306 of IPC, in Crime No.621 of 2022, seek anticipatory bail.
2.The case of the prosecution is that one Thilagamani quarreled with the daughter of the defacto complainant, who is the sister of the deceased Naveenkumar. When it was questioned by the above said deceased Naveenkumar, all the accused said to have assaulted him and insisted him to die. Due to which, on 05.10.2022, at about 10.10 p.m, the deceased committed suicide by hanging himself in a tree. Hence, the complaint.

CRL OP(MD). No.19297 of 2022 3.The learned counsel for the petitioners would submit that the petitioners are innocents and they have not committed any offence as alleged by the prosecution. He would further submit that A3 and A5 was arrested and remanded to judicial custody. Thereafter, they were released on bail. Hence, he prays for grant of anticipatory bail to the petitioners.
4.The learned Government Advocate(Crl.Side) would submit that totally 5 accused are involved in this case. The petitioners are arrayed as A1, A2 & A4. The date of the occurrence is 05.10.2022 and the investigation is in initial stage. Hence, he strongly opposed to grant anticipatory bail to the petitioners.
5.Considering the gravity of the offence and also considering the fact that the investigation is in initial stage, this Court is not inclined to grant anticipatory bail to the petitioners. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 01/11/2022 / TRUE COPY / /11/2022 Sub-Assistant Registrar (C.S.)
