Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a writ of mandamus, directing the respondents 1 to 5 to provide basic facilities of water and drainage connection and a pathway to the petitioner's house situated at No.1/75, North Street, Sethunarayanapuram, Watrap, Virudhunagar District. ORDER
This writ petition is filed for a writ of mandamus directing the respondents 1 to 5 to provide water and drainage connection and also a pathway to the petitioner's house, situated at No.1/75, North Street, Sethunarayanapuram, Watrap, Virudhunagar District. 2.The learned Counsel appearing for the petitioner submits that the petitioner has applied for water and 2/6
drainage connection, which has not been effected so far for the reasons best known the authorities concerned. 3.The learned Additional Government Pleader appearing for the respondents submits that the petitioner wants water connection through a third party's land, wherein objections were raised and therefore, service connection is not effected.
4.This Court by considering the above submission, by order dated 13.02.2023 directed the learned Additional Government Pleader to get written instruction from the official concerned. However so far no written instruction has been filed. However, today the learned Additional Government Pleader on oral instruction submits that the respondents are ready to effect water and drainage connection to the petitioner, but the petitioner wants the water connection through S.No.1156, which belongs to the 6th respondent and there is dispute between them and therefore, water connection could not be effected. However, the petitioner has been suggested to get water connection 3/6
from the existing line as provided to others. 5.Considering the submission made by the learned Additional Government Pleader that they are ready to effect water service connection and drainage connection, as provided to others, this writ petition is closed as no further order is required. However the official respondents shall ensure that water and drainage connection are provided to the petitioner within a period of twelve weeks from the date of receipt of a copy of this order. No costs. Consequently connected miscellaneous petition is also closed.
