ORDER

The Writ Petition has been filed, invoking Article 226 of the Constitution of India, seeking orders, to direct the respondents to issue Look Out Circular and to impound the passport of Frankline Shyam in Passport No.P9343210 in connection with Crime No.3 of 2024 on the file of the third respondent, dated 05.01.2024 by considering the petitioner's representation, dated 11.09.2024 within a time frame as may be fixed by this Court.

2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the State would submit that on the basis of the complaint given by the petitioner, the third respondent, after completing the investigation, has laid the final report and the case was taken on file in C.C.No.1465 of 2024 and the same stands posted to 03.12.2024 for appearance of the accused.

3. Admittedly, as of now no warrant is issued as against the petitioner's husband and the petitioner's husband has planned to come to India shortly. If that be the situation, the question of issuing Look Out Circular at this stage does not arise at all and hence, the very filing of the petition is a clear abuse of process of law and as such, the same is liable to be dismissed.
