30.08.2023 for the offences under Sections 3 and 25(1B)(a) of Arms Act, 1959, in Crime No.276 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 30.08.2023 at about 5.00 p.m., when the police team went for patrol duty, they found the petitioner in suspicious manner and on search they found the petitioner in possession of country made unlicensed gun. Based upon the occurrence, a case was registered and the petitioner was arrested.

3. Seeking bail on the ground that earlier, the petitioner was arrested and remanded to custody for a simple issue of taking the pilgrims to the temple. Now he has been wrongly roped in this case only on the basis of the previous case. Recovery has been made only against the third accused and not from the petitioner. 4.Heard the learned Additional Public Prosecutor.

5. But reading of the FIR, does not indicate the fact narrated by the petitioner. Actually unlicensed gun recovered only from the petitioner and the petitioner is also facing several cases. Eventhough some of the cases have already been disposed, 2/3

considering the bad antecedents, this court is not inclined to grant relief to the petitioner. If he is released on bail, he may abscond.
