This writ petition has been filed for a direction to the respondents to pay interest at the rate of 18% per annum, for the belated payment of commuted value of pension and gratuity.
2. The learned counsel appearing for the petitioner would submit that this Court may issue a direction to the respondents to dispose of the representation of the petitioner, dated 05.04.2016, on merits and in accordance with law, within a specified period.
3. Though the petitioner has claimed the payment of interest at the rate of 18% per annum, for the belated payment of commuted value of pension and gratuity, no details have been furnished before this Court what was the amount paid and when the amount was paid. In the absence of any details, claiming interest at the rate of 18% is not sustainable and hence, the prayer sought for by the petitioner in this writ petition is not maintainable. W.P.(MD)No.7480 of 2016 Petition is dismissed. However, if the petitioner is entitled for any statutory interest, as per the statutory provision, liberty is granted to the petitioner to work out the remedy, in the manner known to law. No costs.
