PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of Mandamus, to direct the 1st and the 2nd respondents to enquire the matter by providing sufficient opportunity to the petitioner by considering his representation dated 14.10.2019 within a stipulated time. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.

2.According to the writ petitioner, the writ petitioner has made a complaint to the first respondent to take action against the 7th and 8th respondents.

3.The learned counsel appearing for the writ petitioner submitted that the writ petitioner is the owner of a Tractor bearing Registration No.TN 59 D 3708 and he is letting out his Tractor for the purpose of transporting building materials from one place to another place. He further submitted that while he is doing his business, the 7th and 8th respondents have interfered with and also harassed him.

4.The learned Additional Government Pleader submitted that when the writ petitioner is doing legal business, nobody can interfere with. He further submitted that in the event of transporting sand and other building materials, it is the duty cast upon the respondents to ask the writ petitioner to produce the licence and to make enquiry of the same.

5.For the above said purpose, as and when the writ petitioner is transporting the building materials to his client, the writ petitioner shall produce the following documents viz., Registration Certificate issued by the Regional Transport Officer, licence granted to him to run the business and other Certificates obtained from the Assistant Director, Department of Geology & Mining, permit issued by the Revenue Divisional Officer for transporting sand, Sales Tax and other requirements issued by the concerned Authorities. On production of those documents, the Official respondents shall not interfere with the petitioner's business. The writ petitioner shall carry all the aforesaid documents with him, during every trip.

6.With the above directions, this Writ petition is disposed of. No costs.
