PRAYER :- For Bail in Crime No.487 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/2nd Accused, who was arrested on 23.07.2023 for the alleged offence under Sections 3 of Explosive Substance Act 1908, in Crime No.487 of 2023, on the file of the respondent police, seeks bail.

2. This petition has been filed on the ground that the first accused granted regular bail by the learned Principal Sessions Judge, Thanjavur.

3. The case of the prosecution is that on 23.07.2023, totally six accused including the petitioner threw petrol bomb at the house of the defacto complainant's house, in which, the door has been damaged. Hence, the complaint.

4. On going through the CD file and on perusal of order passed by the learned Principal Sessions Judge, Thanjavur, in favour of the accused No.1 and 3, it appears that there is group rivalry between two groups of people, over which only, Crime No.486 of 2023 has been registered and subsequently this Crime No.487 of 2023 has been registered.

5. Even though the learned Additional Public Prosecutor would submit that in Crime No.486 of 2023, this petitioner is also involved, the learned counsel for the petitioner would submit that this petitioner's name is not mentioned as an accused in that First Information Report.

6. Considering the nature of offence and also considering that the main accused released on regular bail and the period of incarceration, this Court is inclined to grant bail to the petitioner with certain conditions. 7.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/-

(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Pattukkottai, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
