Petition filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus, directing the respondents herein to produce the person or body of the detenue, the petitioner's son, namely, Sudharsan, S/o.Chandrasekaran, aged about 20 years, before this Court and set him at liberty.

ORDER

(Order of the Court was made by N. ANAND VENKATESH, J.) This petition has been filed by the father of the detenu to produce his son, named Sudharsan, who is said to be missing from 25.04.2022.

2. The learned Additional Public Prosecutor, on instructions, submitted that based on the complaint given by the petitioner, a man missing FIR has been registered by the second respondent in Crime No.339 of 2022 and the investigation is pending.

3. The learned Additional Public Prosecutor further submitted that the detenu had a love affair with a girl and later, the girl seems to have married someone else and she has settled in Erode. The detenu, who was studying in Nursing College, Dindigul, thereafter went missing from 25.04.2022. The call details that were collected from the mobile number of the detenu were also traced and it was seen that the mobile was in possession of someone else. He further submitted that the second respondent is taking all efforts to find the whereabouts of the detenu.

In the considered view of this Court, it would suffice to direct the second respondent to proceed further with the investigation in accordance with the guidelines issued by this Court in K.Sukumari Vs. The Superintendent of Police, Virudhunagar District, Virudhunagar, reported in 2018 (2) - L.W. (Crl) - 636 and take steps to find the whereabouts of the son of the petitioner.
