ORDER

The Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders to transfer the investigation in Crime No.189 of 2024 on the file of the second respondent to some other independent or specialized agency like CBI or CBCID of Madurai District.

2. It is evident from the records that on the basis of the complaint given by the petitioner, FIR came to be registered in Crime No.189 of 2024 on 02.09.2024 for the alleged offence under Sections 296(b), 127(2), 115(2), 303(2)351(2) of BNS and Section 4 of TNPHW Act.

3. The learned counsel for the petitioner would submit that even subsequent to the registration of FIR, the second respondent has not taken any steps either to recover the properties or to proceed with the investigation.

4. The learned Government Advocate (Criminal Side) appearing for the State would submit that both the accused have already obtained anticipatory bail and the investigation is in progress. 2/4

5. Recording the submission made by the learned Government Advocate (Criminal Side), the second respondent is directed to proceed with the investigation and complete the same within a period of three months from the date of receipt of copy of this order. The Deputy Superintendent of Police, Usilampatti Division, Madurai, is directed to monitor the same.
