ORDER

The Criminal Original Petition has been filed to transfer the investigation in the case in Crime No.1099 of 2020 from the third respondent to the second respondent.

2.The case of the petitioner is that due to money dispute between the petitioner and the accused, on 25.09.2020 at 10.00 a.m., the accused scolded the petitioner in filthy language and threatened him with dire consequences. Thereby, the petitioner made a complaint before the third respondent and the same was registered in Crime No.1099 of 2020. Thereafter, the petitioner filed Crl.O.P.(MD)No.2460 of 2021 before this Court and the same was allowed on 17.02.2022 and directed the respondents Police to complete the investigation and file a final report within a period of six months from the date of receipt of a copy of that order. But till date, the third respondent police have not completed the investigation and filed a final report. Hence, the present petition is filed for transfer of investigation.

3.The learned counsel for the petitioner would submit that this Court may issue a direction to the second respondent to complete the investigation and the same may be monitored by the higher official, namely, the Deputy Superintendent of Police, within a reasonable time as fixed by this Court. 4.The learned Additional Public Prosecutor appearing for the respondents would submit that this Court may issue a direction to the respondents police to complete the investigation within a reasonable time as fixed by this Court. 2/4

5.In view of the above, the third respondent is directed to complete the investigation in Crime No.1099 of 2020 and file a charge sheet before the concerned Court, within a period of twelve weeks from the date of receipt of a copy of this order. The investigation shall be monitored by the concerned Deputy Superintendent of Police.

6.With the above directions, this Criminal Original Petition is disposed of.
