Mr.R.Suresh Kumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.163 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.2, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of IPC r/w. 21(5) of MMDR Act, 1957, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 07.08.2023, at about 8.30 hours, when the defacto complainant party conduct inspection in the occurrence place, the petitioner along with other accused persons involved in illegal sand theft. They found 80 bags 1/3

of river sand. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. 4.The learned Government Advocate (Crl. Side) would submit that there are three previous cases pending against the petitioner. Out of which one is similar in nature and another one is under Section 302 of IPC. 5.Considering the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
