3. The petitioner's husband was working in the respondent department and he died on 03.08.2023. 4. The learned counsel for the petitioner submitted that the mother of the deceased, who is also a legal heir, has also raised an objection.
5. At the time of death, the petitioner's husband was aged 32. Even though the petitioner's mother-in-law could be the legal heir for her deceased son, she cannot be an eligible legal heir to get the benefits of compassionate appointment in view of her age. Hence, the respondents shall not insist the petitioner to get a no objection from the mother of the deceased.
6. In view of the above stated reason the writ petition is disposed of and the respondent is directed to consider the application of the petitioner on merits and pass orders within a period of four weeks from the date of receipt of a copy of this order. No costs. 10.06.2024 RR 3/5
