PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Mandamus, directing the 3rd respondent to 1/5
enforce the order dated 09.05.2023 passed by the 4th Respondent within the time stipulated by this Court.
For Petitioner : S.Poornachandran For R1 to R4 : Mr.SS.Madhavan Government Advocate (Crl.side) O RDER This Writ Petition is filed under Article 226 of the Constitution of India seeking for a direction to the respondent police to enforce the order dated 09.05.2023 passed by the 4th respondent in favour of the petitioner under Section 24 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. 2.It is submitted by the learned counsel for the petitioner that on the representation made by the petitioner, the respondent No.4, the Revenue Divisional Officer, has passed orders under Section 24 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and the said order was placed before the respondent No.1/the District Collector to implement the same. However, the said orders were forwarded to the respondent No.3/the Deputy Superintendent of Police, but no action has been taken. It is submitted further that the Sub Inspector of Police, Vilathikulam though has served summons dated 21.08.2023, the orders have not been implemented so far. 2/5
3.The learned Government Advocate (Crl.side) submits that the said proceedings were received from the respondent No.1 and an enquiry is being initiated and within short time, they will implement the same. 4.Since the orders have been passed by the respondent No.4, which is forwarded by the respondent No.1, the respondent No.3 is required to implement the same under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. Therefore, the respondent police are directed to consider the representation in respect of orders passed by the respondent No.4 dated 09.05.2023, as quickly as possible, not later than 2 weeks from the date of receipt of a copy of this order. 5.With the above directions, this Petition is disposed of.
