O R D E R

This Writ Petition has been filed for a Writ of Mandamus to direct the respondents to re-designate us in the post of Assistant Engineer from the date of promotion as Junior Engineer with all attendant service and monitory benefits in the light of Rule 3 of Tamil Nadu Town Panchayats Engineering Service Rules, 2022 within the time limit that may be stipulated by this Court.

2.By a Government order G.O.(D)No.679 Municipal Administration and Water Supply (MC7) Department, dated 14.12.2023, the Government issued the following orders:

(i) First promotion after commencement of Tamil Nadu Urban Local Bodies Rules, 2023 shall be given to the eligible employees of Corporations/ Municipalities/Town Panchayats by the appropriate competent authority prescribed under the Tamil Nadu Urban Local Bodies Rules, 2023, by taking into account of the qualifications prescribed in the service rules which was existed prior to the commencement of the Tamil Nadu Urban Local Bodies Rules, 2023 by invoking provision made in rule 202 of the of said Rules.

(ii) The Additional Chief Secretary/ Commissioner, Greater Chennai Corporation, the Director of Municipal Administration and the Director of Town Panchayat are permitted to give such first promotion to fill up the vacancies which exist in the Urban Local Bodies upto 14.03.2024 by the appropriate authority competent under the Tamil Nadu Urban Local Bodies Rules, 2023 by taking into account of the qualifications prescribed in the service rules that existed prior to the commencement of the Tamil Nadu Urban Local Bodies Rules, 2023.

(iii) The vacancies which are arising from 13.04.2023 to 14.03.2024 shall be filled up taking into the account of the crucial date of 15.03.2023.

3. In a similar identical facts of the case, this Court in W.P.No.25990 of 2024 taking note of the fact that the petitioners therein had also made a representation for the very same relief sought for by the 3/6

petitioners herein, directed the first respondent therein to consider the representation of the those petitioners on merits and in accordance with law, after affording an opportunity to all concerned. The petitioners in the present case are also similarly placed persons.

In view of the same, the petitioners are directed to make a fresh representation to the respondents 1 and 2, seeking re-designation to the post of Assistant Engineer from the date of their promotion as Junior Engineer along with all consequential benefits. On such representation being made, the respondents are directed to consider the said representation in the light of Rule 3 of the Tamil Nadu Town Panchayats Engineering Service Rules, 2022, G.O.(D)No.679 Municipal Administration and Water Supply (MC7) Department, dated 14.12.2023 and also in the light of the direction issued by this Court in W.P.No. 29550 of 2024 dated 11.07.2025 and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

5. The writ petition stands disposed of with the above direction. There shall be no order as to costs.
