WP(MD) No.8888/2016 PRAYER in WP(MD) No.8888 of 2016: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarifed Mandamus, calling for the records pertaining to the impugned Government Order in G.O.Ms.No.88, dated 20.01.2016 passed by the first respondent and quash the same and consequently direct the respondents 1 to 5 to conduct proper enquiry and provide adequate compensation to the peoples who were really affected in the communal clash taken place in the month of October 2008 vide representation dated 24.03.2016.

PRAYER in WP(MD) No.21292 of 2016: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents to consider the petitioner's representation dated 24.03.2016. For Petitioner : Mr.K.Seemaraj For Respondents : Mr.P.T.Thiraviam Government Advocate (In both WPs) C O M M O N O R D E R The petitioner in both the writ petitions are one and the same and he claims that he is one of the victims in the communal clash that took place in Peraiyur Taluk, Madurai in the year 2008. These writ petitions have been filed seeking compensation. 2.The learned counsel appearing for the petitioner submits that a wall of untouchability constructed by the Vellalar community people of the Uthapuram Village was demolished by the Government Officials, as a result, a communal clash took place in the year 2008 in Uthapuram, Peraiyur Taluk, Madurai. According to the learned counsel, the compensation has been paid only to a set of 8/12
people, who represented by a political party. The learned counsel has relied upon the representation given by others submits that he is also one of the signatory to the representation. However, no compensation has been paid to him. Hence, these petitions. 3.The learned Government Advocate appearing for the respondents 1 to 5 submits that an enquiry was conducted, based on which, compensation of Rs.14,60,000/- was given to 191 eligible persons. He further submits that a sum of Rs.1,85,000/- has also been returned to the Government as unclaimed. 4.Recording the submission made by the learned Government Advocate, these writ petitions are disposed of with a direction to the petitioner to submit a fresh representation along with the relevant documents that he is also one of the victims in the communal clash that occurred in Uthapuram, Peraiyur Taluk, Madurai in the year 2008, within a period of two weeks from the date of receipt of a copy of this order. In the event, if any such 9/12
representation is submitted, the District Collector shall conduct an enquiry and pass necessary orders within a period of twelve weeks from thereon. No Costs. Consequently, connected Miscellaneous Petitions are closed.
