ORDER
The appellant is the defacto complainant in SC.No.15 of 2017. On the complaint of this appellant, a case was registered and a final report was filed, which was also tried in SC.No.15 of 2017 before the Additional Sessions Court, Karur, as against the respondents 2 to 5 for the offence u/s. 447, 294(b), 506(ii) IPC r/w Section 3(1) of Tamil Nadu Property (Prevention of Damage & Loss) Act. The trial Court, in conclusion of the trial, by judgment dated 13.07.2017, acquitted the respondents 2 to 5. As against the same, the appellant / defacto complainant has preferred the instant appeal.
2.When the appeal is taken up for final hearing, learned Counsel for the appellant, by relying upon a letter of the appellant dated 21.06.2023 of 2/4
the appellant, submitted that the appellant has instructed him to withdraw the appeal. The letter dated 21.06.2023 of the appellant along with the letter dated 30.06.2023 of the appellant's Counsel is also placed before this Court. 3.In view of the above submission and the letter dated 21.06 & 30.06.2023, this criminal appeal is dismissed as withdrawn.
