ORDER
The present writ petition has been filed seeking for the issuance of Writ of Mandamus, to direct the 3rd respondent to permit the petitioner to continue his service in the 3rd respondent office as Scavenger with all service benefits in accordance with direction issued by the 1st respondent in Na.Ka.No.Va12/34405/2014 dated 15.06.2015.
2. The case of the petitioner is that he was working as https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)No.8971 of 2016 scavenger in the 3rd respondent for the past 24 years and he has received monthly salary of Rs.3,500/- on consolidated basis. From March 2014, the 3rd respondent has not paid the salary and not allowed the petitioner to work. Therefore, he made representations dated 12.08.2014 and 10.09.2014 before the 2nd respondent, who in turn, directed the 3rd respondent to allow the petitioner to continue to work as Scavenger, vide his letter dated 23.09.2014. Even thereafter, the petitioner was not allowed to work. Hence, the present writ petition has been filed.
3. Today, when the matter is taken up for consideration, the learned Special Government Pleader appearing for the first respondent, on instructions, submitted that during the pendency of the writ petition, the petitioner was permitted to work as Scavenger and also granted time scale of pay.
