PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 to cancel the patta in Patta No.534 in respect of the property measuring to an extent of 31 cents comprised in Survey No.315/2 situated at Akkiyampatti Village, Marungapuri Taluk, Trichy District and issue a patta in favour of the petitioner by considering her representations dated 12.03.2022 and 20.08.2024. 1/5

The petitioner has approached this Court, seeking a Mandamus, directing the respondents 1 & 2 to cancel the patta in Patta No.534, in respect of a property in Survey No.315/2 situated at Akkiyampatti Village, Marungapuri Taluk, Trichy District to an extent of 31 cents and to issue patta in her favour, by considering her representations, dated 12.03.2022 and 20.08.2024. 2.The learned counsel appearing for the petitioner submits that this petitioner is the owner of the property in S.No. 315/2. However, the Tahsildar has wrongly issued patta in patta No. 534, in favour of the respondents 3 & 4 herein. He further submits that the petitioner has submitted an application before the Tahsildar and the same has not been considered and therefore, the petitioner has approached this Court.

3.Mr.D.S.Nedunchezhian, learned Government Advocate, who takes notice for the respondents 1 & 2 submits that based on the representation of this petitioner, dated 20.08.2024, the Tahsildar, Marungapuri Taluk has conducted an enquiry and also submitted a report before the Revenue Divisional Officer, Srirangam Taluk, Trichy and the same is pending with the first respondent/the Revenue Divisional Officer.

4.Considering the relief to be granted to this petitioner, notice to the respondents 3 & 4 is dispensed with. 5.This Court considered the rival submissions made and also perused the materials placed on record.

6.It appears that the second respondent has already considered the representation of this petitioner, dated 20.08.2024 and also submitted a report before the Revenue Divisional Officer with regard to the subject property in Patta No.534 and the same is 3/5

pending with the first respondent. Therefore, this writ petition is disposed of with a direction to the first respondent to conclude the enquiry, if any, with regard to the subject property, within a period of twelve weeks from the date of receipt of a copy of this order, after affording sufficient opportunities to the respondents 3 & 4.
