Mr.B.Nambiselvan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.307/2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323, 307 & 506(ii) of IPC and Section 4 of TNPHW Act, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution as per the defacto complaint's version is that on 15.09.2023 at about 01.00 p.m., after participating in the Kodai festival, they were 1/3

returned. At that time, there was wordy quarrel between the some persons. In pursuant to the above said wordy quarrel at about 1.30 p.m., the accused person picked up quarrel with the defacto complainant and caused assault upon him. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. 4.The learned Government Advocate (Crl. Side) would submit that the petitioner is a history sheeted person having five previous cases. Out of which one is under Section 302 of IPC.

5.Considering the bad antecedents, this Court is not inclined to grant anticipatory bail to the petitioner.
