PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the third respondent to comply the order of the second respondent vide his proceedings dated 10.12.2015 in letter No.Ko.ThoNu-03 (115 & 117) 2015 and to take appropriate action against unauthorized saw mill running in the residential area on the basis of the representation dated 13.04.2016.

O R D E R

[Order of the Court was made by D.KRISHNAKUMAR, J.] Prayer in this writ petition is to direct the third respondent to comply with the order of the second respondent vide proceedings dated 10.12.2015 in letter No.Ko.ThoNu-03 (115 & 117) 2015 and to take appropriate action against the unauthorized saw mill, which is being run in the residential area, on the basis of the petitioner's representation dated 13.04.2016.

2. This writ petition is of the year 2016. However, the fourth respondent, against whom the relief is sought for, has not filed counter affidavit so far.

3. Considering the nature of the relief sought for the petitioner, we direct the third respondent / Executive Officer, Alangulam Town Panchayat to take necessary action, based on the proceedings of the second respondent, dated 10.12.2015, as early as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order, if so far no action has been taken.

4. With the above direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. [D.K.K., J.] [R.V., J.] 02.01.2024 NCC :
